Licence Terms & Conditions
Licence - In exchange for your payment, Gold Seal Risk Management Services Pty Limited and/or Gold Seal Practice Management Pty Limited grants you a non-exclusive, non-transferable right to use the Gold Seal Product you have purchased.
You may use, adapt (and reproduce) Gold Seal’s Products in connection with the internal management and administration of your business activities and in the course of providing financial advisory services to your clients. Unless authorised in writing by Gold Seal, you may not reproduce any part of any Gold Seal Product for sale or incorporation in any product or service intended for sale or supply to third parties.
You are not entitled to copy, modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works based on Gold Seal’s Products (except to load in your computer or network for use pursuant to this Licence) By opening and using Gold Seal’s Products you accept these Licence Terms and Conditions.
You agree and acknowledge that all intellectual property rights of any type in Gold Seal’s Products are owned by Gold Seal I.P. Pty Limited ; and distributed by Gold Seal Risk Management Services Pty Limited and/or Gold Seal Practice Management Pty Limited pursuant to a licence from Gold Seal I.P. Pty Limited
Disclaimer - Gold Seal’s Products are only a guide, not a blueprint. Their purpose is to prompt and assist insurance intermediaries to develop their own procedures and quality standards.
Nothing in Gold Seal’s Products should be taken to mean or imply that any particular procedure or quality standard is satisfactory or appropriate (or unsatisfactory or inappropriate). No person should rely upon Gold Seal’s Products in lieu of obtaining professional advice on his or her own situation or on any particular procedure or standard.
The authors, editors and publishers make no representation, and give no warranty, express or implied, as to the accuracy or completeness of Gold Seal’s Products or any part of them.
Limitation of Liability - Except as provided below, all express and implied conditions, warranties and liabilities (including liability for negligence) regarding the condition, completeness, accuracy, suitability, quality or title to Gold Seal’s Products are negated and excluded.
You acknowledge and agree that we are under no liability to you or any third party in respect of any loss or damage, including consequential loss or damage, however caused, whether by negligence or otherwise which may be suffered or arise as a result of your use of Gold Seal’s Products.
Nothing in these terms excludes, restricts or modifies any condition, warranty, right or remedy which is conferred on you by the Trade Practices Act 1974 or any other consumer legislation as amended (the Acts). If we breach any condition or warranty that has been implied by the Acts, our liability for that breach will be limited to our choice of:
- In the case of supply of goods the replacement of the goods or the supply of equivalent goods, the repair of goods, the payment of the cost of replacing the goods, or the payment of the cost of having the goods repaired; and
- In the case of the provision of services, the re-supply of the services, or the payment of the cost of having the services re-supplied.
Law - This Licence and Terms and Conditions are governed by New South Wales Law. |
